2.1. WTO, FTAs:

2.2. AFAS:

a) Only commit themselves in the fields of engineering, natural sciences and technology, business administration and business sciences, economics, accounting, international law and language training.

2.3. AANZFTA:

a) Only committed in the fields of agriculture, architecture, shipbuilding, corporate governance, management, computer science, construction, information systems, dental services, economics , pedagogy, engineering, environment, surveying, community service, land and marine resources, animal husbandry, language studies, law, legal studies, life sciences, manufacturing, mathematics, medical science, medicine, multidisciplinary education, nursing, pharmacy, physical science, science, service, food and tourism, transportation, veterinary science, expression arts performance and vision.

b) Scope of activities: lower secondary education (including only: higher secondary education (92220) and technical and vocational secondary education (92230) for students who have completed the 9th grade program as prescribed by Vietnamese law), higher education, adult education and other educational services (including foreign language training).

c) The training program must be approved by a competent state agency.

2.4. The law of Vietnam:

a) Investment rate

– Investment project to establish a preschool educational institution: at least VND 30 million/child (excluding land use costs).

– Investment project to establish a general education institution: at least VND 50 million/student (excluding land use costs). The minimum total investment capital is calculated based on the time when the training scale is expected to be highest, but not less than VND 50 billion.

– Investment project to establish short-term training and retraining establishments: at least 20 million VND/student (excluding land use costs).

– Investment project to establish a higher education institution: at least 150 million VND/student (excluding land use costs). The minimum total investment capital is calculated based on the time when the training scale is expected to be highest, but not less than 300 billion VND.

– An investment project applying to open a branch of a foreign-invested educational institution in Vietnam must have an investment rate and investment capital at least equivalent to the level prescribed for the establishment of the above-mentioned educational institutions.

– For foreign-invested educational institutions that do not build new facilities but only rent them out or have capital contributed by Vietnamese parties with existing facilities to carry out their operations, the minimum investment must reach 70% of the prescribed level.

b) Form of investment: joint venture, 100% capital of foreign investors.

– Pre-school educational institutions (kindergarten, kindergarten, nursery school) implementing educational programs according to foreign programs for children who are foreigners.

– General education institutions (elementary schools, junior high schools, high schools, high schools with many levels of education) implementing education programs according to foreign programs, granting foreign degrees. for foreign students and a part of Vietnamese students in need (no more than 10% of the total number of students in primary and lower secondary schools; not more than 20% of the total number of students in the school) high school).
